To enable Pogo Direct to process your booking it is necessary to collect certain personal details from you. These details will include, where applicable, the names of party members, at least the party leader’s contact details (including email address), at least the party leader’s credit/debit card details, etc which will not be stored. If further details are required, we will ask you for these. We will use the contact details you have supplied to correspond with you in relation to your booking or enquiry. We will also need to pass your details to the third parties who need to know them so that your chosen accommodation can be provided or your enquiry can be dealt with. The owner of the accommodation you have booked or enquired about may contact you direct using the details you have supplied. If necessary your details may be passed to third parties in countries outside of the European Economic Area, in order to arrange for your booking to be provided or enquiry answered. These countries may not provide the same level of protection for your personal data as the United Kingdom. By submitting your booking or your enquiry to us, you agree to your personal details being processed in the way described above.

If you have subscribed to our e-mail service or have made a booking for, or an enquiry about, the services we offer, Pogo Direct may send you very targeted promotional e-mails about the services and special deals on offer unless you have opted out of receiving these.

It may be necessary to disclose our customer database, including any personal data relating to you contained therein, to a third party who acquires or attempts to acquire all or substantially all of the assets or stocks in our company or our website whether by merger, acquisition, reorganisation or otherwise.

Except where expressly permitted by the Data Protection Act, we will only deal with the personal details you give us as set out above unless you agree or tell us otherwise. We have appropriate security measures in place to protect this information.

You are generally entitled to ask Pogo Direct (by letter or e-mail) what details of yours are being held or processed, for what purpose and to whom they may be or have been disclosed. We will charge a fee to respond to such a request. Pogo Direct promise to respond to your request within 40 days of receiving your written request and fee. In certain limited circumstances we are entitled to refuse your request.

Standard Terms & Conditions  

1. Access to and use of any information on this website is conditional on your acceptance of these website use conditions without modification. Please read them carefully. We recommend you print out and keep a copy of them for future reference. If you do not wish to accept any part of them, you must not use our website. In these Conditions, “you” and “your” means any and all persons using this website “we”, “us” and “our” means Pogo Direct “Member” means property owner who may be the Member or the Lawful Agent.
  
2. Our aim is to provide you with an online marketplace of holiday accommodation and / or other suitable services or products related to that market place, or considered of interested to those making such enquiries and facilitate interaction between you and our Members and selected business partners, then consequently book and pay online safely and securely. Pogo Direct accepts no responsibility for the accuracy of the property details, whether it be the description, the prices, the terms or the availability. This is because such information is maintained by the Member using the software and systems provided for them by us. Although we initially check the details of every property uploaded for any obvious mistakes when they are first submitted, you must be aware that we do not physically inspect the properties or interview the Member. You must also be aware that changes can be made to the property listing by the Member at any time after the initial checking with or without our knowledge. In order to give you the maximum protection and information, we invite you to review the property after your stay and submit your thoughts via ‘Contact Us’. It is our intention to use this information to create a ‘knowledge base’ for future travellers to review.
 
3. You should be aware that we actively encourage all Members to use the Pogo On-line Booking Service (POBS) not only for bookings derived from www.pogo-direct.co.uk but from all other sources too. This has the advantage of gaining the maximum information about the Member and their property as every person booking via POBS will receive a ‘customer satisfaction survey’.

4. It is important that you understand that you are NOT booking with Pogo Direct but with the Member, we act only as a conduit to facilitate the transaction. Your booking is subject to the Terms & Conditions of the member and these will be available to view and / or download before you book. This is not dissimilar to booking holiday accommodation from a magazine, newspaper advertisement direct with the owner or via an agent. These differing media cannot be held responsible for facts that they are not privy to, Pogo Direct is no different. 

5. Our liability to you extends solely to the correct functioning of the booking and payment systems, although the underlying pricing, discounting and all other variable inputs to do with payment terms are controlled directly by the Member and are therefore the Member’s responsibility.
  
6. All accommodation bookings are subject to the Member’s Booking Conditions. These will be shown when you make a booking request. Pogo Direct provides members with a template and variable input screens so that Members can quickly and easily create their own contracts. Each one however will be customized according to the members individual preferences and you should read them carefully. We recommend that you print out and keep a copy of these for your future reference. This is the contract that you will need to refer to in the unlikely event that a problem arise and all complaints should be directed, in the first instance to the Member. 

   6.1 Nothing on this website constitutes an offer on the part of Pogo Direct. The information provided constitutes an invitation to you, to make an offer to the Member of the accommodation, on the stated terms, to rent/ purchase the accommodation we feature. The Members may accept or decline any such offer. All accommodation featured or referred to is at all times prior to specific confirmation subject to availability and no warranties, promises or representations are given as to availability.
  
   6.2 As a condition of your use of this website, you warrant to us that you will not use it or any material or information on it for any purpose that is unlawful or prohibited by these Conditions. You warrant that you are at least 18 years old and have the legal authority to use this website in accordance with these Conditions. You agree to be financially responsible for all charges, fees and other sums of whatever nature which arise out of your use of this website.
  
   6.3 This website is for your personal and non-commercial use. No part of this website may be reproduced in any form without our prior consent, other than temporarily in the course of using our service or to keep a record of a transaction entered into using our service. You must ensure you check all details of the chosen accommodation any other services (including the price) with the Member by email or other approved means at the time of booking.

We cannot accept any liability whatsoever and howsoever arising in relation to any such other websites (including, for the avoidance of doubt and not by way of limitation, any inability to access or delay in accessing any such other website) or in relation to any material or information appearing on them or which you may otherwise come across after leaving our site by way of a hypertext link or any other means.

Terms and Conditions

All advertisers on the pogo-direct.co.uk website accept the following Terms and Conditions:

1. Authority

(a) The advertiser hereby confirms that they are either the legal owner(s), or have the authority of the legal owner(s) of the property and that they are legally entitled to market the property for rental.
 
2. Layout

(a) pogo-direct.co.uk control the overall design and functions contained within its site.

3. Content

(a) The advertisers of each property are totally responsible for the accuracy of all the information contained within that advert (such advertisements are governed by law).
(b) The advertiser is to use the tools provided on the site.
(c) pogo-direct.co.uk is not able to confirm the accuracy of the property description.
(d) The advertiser indemnifies pogo-direct.co.uk against all costs, expenses or losses arising from any claim relating to any content of each advertisement.
(e) pogo-direct.co.uk will take the utmost care of all materials and photographs provided for each advertisement, but cannot be held liable for any loss or damage however caused.
(f) All content, including photographs, must be supplied in the required format.
(g) The advertiser will agree and identify a weekly rental charge, which includes all utilities and community charge. (Long term rental may vary).

4. Amendments

(a) pogo-direct.co.uk reserve the right to amend or remove any content of any advert at its own discretion.

5. Availability

(a) It is the advertisers responsibility to ensure that the availability of each property is accurate and up to date.

6. Liability

(a) pogo-direct.co.uk cannot be held responsible for the loss of service provided by any outside parties and any such lost revenue.

7. Copyright

(a) The responsibility to ensure that no breach of copyright is applied to any content, including photographs, lies wholly with the advertiser.
(b) Each advertiser indemnifies pogo-direct.co.uk against any action brought for any breach of copyright and is held responsible for any costs resulting from any such breach.
(c) pogo-direct.co.uk claims copyright to any electronic images or any photographs supplied by the advertiser.

8. Text/Picture/Embedded Hyperlinks

(a) pogo-direct.co.uk encourage the distribution of its website through links to advertisers own suitable websites.
(b) pogo-direct.co.uk reserves the right to refuse hyperlinks to, or addresses of, other web sites from advertisers' pages, and to remove links or web addresses without notice at our sole discretion.
(c) pogo-direct.co.uk reserves the right to charge for hyperlinks at any time.

9. Advertising more than one property

(a) Each property advertised on pogo-direct.co.uk describes only one property that is available for rental. 

10. Advertising Authority

(a) pogo-direct.co.uk reserve the right to review all advertisements displayed on its website. It reserves the right to amend, refuse or withdraw any property at its own discretion, without refund or liability for any loss, should it consider the action of any individual / advertiser are not meeting the requirements or spirit of this agreement.
(b) Any complaint received concerning any advertised property will be investigated and actioned as considered necessary within this agreement.
(c) All properties will be removed if requested in writing by the authorised advertiser. No refunds will be issued.

11. Payment for this service

(a) Payment can be made by using major credit and debit cards, BACS or cheques from a UK bank. Payments can currently be accepted in Pounds Sterling, Euros and Dollars. 

12. Charges/Payments

(a) Charges are as identified on the website and cover the fees relating to bookings made for all properties listed.
(b) Pogo Direct offers a “Commission Only Service”. 
(d) All Members agree to pay Pogo Direct a percentage fee, usually 15%, of the total reservation charge for travellers booked through our website. (Unless otherwise agreed in writing or by the issuing of a code from Pogo Direct which when entered will identify a reduced rate). Such percentage fees include all bank charges and for the use of our secure online Credit / Debit Card facility for the deposit only.
(e) A minimum, non refundable, deposit of 25% will be paid by the traveller at the time of booking to Pogo Direct and held as contributions towards our commissions and for balances to be used for final calculations and disbursements of funds. 
NOTE: All Members must note the non refundable deposit on their own advertisement.
(f) Pogo Direct will pay balance payments of the deposits to the advertiser after 28 working days after receipt of cleared funds or 10 working days after the completion of the holiday. Such refunds will fall in line with the refund instructions below.
(g) Balance payments from the traveller for their booking, together with any breakages deposits, can then be paid direct to the advertiser at the specified time.
(h) If our secure online Credit / Debit Card facility, or banking facility, is offered to and used by the traveller for the balance payment then, balance payments of funds to the advertiser will be due, after the latter of, 10 working days after completion of the holiday or upon receipt of cleared funds.
(i) Balance payments requests from the advertiser must be made by completing and forwarding the payment request form online.
(j) Pogo Direct will make payments within 10 working days of receiving a correctly completed payment request form online. All such payments, less deductions, will be made by BACS.
(k) Balance payments by the traveller for their booking can be made by using our secure online Credit / Debit Card facility. (Separate terms and conditions apply).
(l) All such balance payments using this methods will incur a handling charge of 3% to the advertiser with refunds as noted above.
(m) An administration fee of £7.50 per transaction, is to be charged towards the cost of receiving and refunding all balances via BACS (UK only. A further £10.00 per transaction is to be charged for Non UK Accounts).
(n) The advertiser is responsible for refunding the breakages deposit to the traveller on completion of the holiday. If this deposit is paid by credit / debit card then Pogo Direct will act as arbitrator in the case of any dispute. Any such refunds, agreed or dictated, concerning any dispute may be refunded by Pogo Direct with such funds then being paid by the advertiser to Pogo Direct within 7 days.
(o) Charges are subject to VAT (as per the VAT policy).

13. Cancellation Policy

(a) All Members must identify and comply with their cancellation policies. Any monies paid by credit / debit card will be refunded by Pogo Direct unless funds have already been paid to the advertiser, as above, in which case such refunds will be refunded by the advertiser.
(b) Pogo Direct reserve the right to verify any cancellations made by the advertiser once a booking has been made and accepted by Pogo Direct. Verification may include liasing with the traveller.
(c) Pogo Direct reserve the right to charge a minimum fee of £50 plus up to the fee it would have generated had such a cancellation not been instructed by the advertiser.

14. Mutual Benefit

(a) The pogo-direct.co.uk website is available for the benefit of both the company and the advertiser. Any actions considered not to be in the best interest of either party will be actioned immediately, including the removal of any advertisement without refund. Such actions could include unsolicited emails, website links or activities / actions that could effect the reputation or revenue of the company.

15. Legal Requirements

(a) All terms and conditions are governed by English law and advertisers accept the exclusive jurisdiction of the English courts to rule on any disputes.

16. Data

(a) Your details are stored by us for marketing purposes and to keep you informed of any special offers and events. Occasionally we may also disclose your information to carefully selected third parties. To opt out of this facility return to the 'New Advertisers Register Here' page and tick the box provided. Please remember, if you do we will be unable to notify you of any special offers, discounts or free gifts.

17. Credit/Debit Card Facility

(a) All Members may allow the traveller booking their property to use our secure online Credit / Debit Card facility by requesting this function at any time and as such are deemed to accept the Terms & Conditions associated with its use.
(b) A 3% handling fee is to be charged for the use of this payment facility. This fee is already included within the agreed percentage fee for the “Commission Only Service” Members for the deposit only.
(c) All balance payments will fall in line with the identified payment instructions.

18. Commissions

Commissions can be generated by any of the following methods:

(a) Generation of revenue from links for services or products offered by our business partners (see separate Page). This will include any links on Members own sites or all links on our White Label Site.
(b) Generating bookings for properties not managed or owned by the advertiser, but included on either your own website or generated via your own enquiries that you are not able to fulfil.
(c) All such commissions will be based on a calculation of 15% of the net commission generated by Pogo Direct for each transaction.
(d) All commissions will be credited against or added to refunds and will fall in line with the identified payment instructions.

19. VAT

The need to charge VAT is as follows:

(a) 17.5% of charges for those based in the UK.
(b) Nil for all others.
(c) Your VAT liability is to be noted at the time of initial registration.
(d) All such payments will be administered at the time of calculation.
